Police had said Mr Pokorny told them Mr Terry had gone missing during the trip after a heavy storm.

Acting attorney general David Esparon told Nation yesterday that the Austrian had been “charged with provisional charges which have been dropped on the basis of the evidence”, adding the man could be charged again if necessary.

The provisional charge was that he had failed to do an act which was his duty to do to save a life.

Court officials confirmed there was an order from a local judge to release Mr Pokorny and hand him back his passport.
