FTC to address issue of expired medicines with health ministry |22 September 2012

The Commission wishes to bring to the attention of the general public that the Consumer Protection Act 2010 (the Act), expressly states under Section 24 that a person shall not offer to supply, display or supply any goods at a date later than the expiry date of the goods.

Any person who supplies goods at a date later than the expiry date shall be in breach of Section 24 (1) of the Act and shall be liable for any loss or damage suffered by a consumer who has consumed the expired good.

In the light of this, the Commission will be liaising with the Ministry of Health to effectively resolve this issue in accordance with the Consumer Protection Act.
