Contractors fined for breaching Consumer Protection Act 2010 |13 December 2013

Premier Building Maintenance Contractor and Property Management and Gerrard Jeannevole have both been ordered by the Board of Commissioners of the Fair Trading Commission (FTC) to refund the sum of R100,000 and R19,000 respectively, after being found to be in breach of the Consumer Protection Act 2010.

Both cases involved breaches of undertakings (agreement between respondent and the Commission in relation to a complaint).

The Board of Commissioners have also imposed the following penalties;

Premier Building Contractor: a total of R15,000;

• R5,000 for contravening Section 40 (1) (a) -- failure to perform and complete a service in a timely manner and give a consumer notice of any unavoidable delay in the performance of the service;

• R5,000 for contravening Section 40 (1) (b) -- failure to perform a service in a manner or a quality that a person is entitled to expect;

• R5,000 for contravening Section 70 -- failure to comply with an undertaking of the Commission.

Mr Jeannevole: the sum of R5,000 for contravening Section 70 -- failure to comply with an undertaking of the Commission.

Both rulings were pronounced on November 27, 2013.
