NDEA communiqué Man convicted for drug offences |23 May 2017

Roy Patrick Brioche, an unemployed 39-year-old man residing at Bel Air, has been convicted for possession with intent to traffic in illegal drugs.

Brioche was arrested on August 11, 2016 at St Louis in possession of a total of 16.33 grammes of heroin and 43 grammes of cannabis along with a digital scale. His case was being heard in the Supreme Court by Judge Burhan and was set for trial. However on May 11, 2017 Brioche pleaded guilty to the two charges against him. On May 19, 2017 he was sentenced on two counts. On Count 1, being in possession with intent to traffic in a quantity of 16.33 (pure 6.33) grammes of heroin (diamorphine), he was sentenced to a term of 3 years imprisonment and a fine of R10,000. On Count 2, being in possession with intent to traffic in a quantity of 43 grammes of cannabis, he is to serve a term of 6 months imprisonment and a fine of R5,000.

The term 3 years and 6 months imprisonment shall run concurrently.

In default of payment of the fine of R15,000, Brioche will serve a term of 6 months imprisonment which would run consecutive to the term of 3 years imposed on him.

His time spent on remand will be deducted from his sentence.
