Vijay Construction wins appeal against EEEL |15 December 2017

Vijay Construction has won its appeal against Eastern European Engineering Proprietary Limited and will not have to pay a sum of 18 million euros with interest.

The Court of Appeal delivered the judgment this week after Vijay Construction had appealed a decision by an arbitrator for it to pay the sum of 18 million euros with interest after the Eastern European Engineering Proprietary Limited (EEEL) had filed a case for breach of contract.

Vijay Constructor had signed six contracts with EEEL for the construction of the Savoy Resort & Spa. Following the arbitrator’s decision, the EEEL filed a case before the Supreme Court to enforce the award and although Vijay Construction asked the court to quash the award since it is a foreign award, Justice Fiona Robinson gave the decision in favour of EEEL in April this year. Vijay Construction then decided to appeal the decision in the Court of Appeal.
