Volcère cuts witnesses number to five in contempt case |27 January 2012

Attorney general Rony Govinden had earlier said the prosecution – which he is leading – will call four witnesses.

Mr Volcère was yesterday expected to plead afresh to contempt of court charges after the attorney general’s office added a fourth charge to the original three, but when the court convened, judge Mohan Niranjit Burhan said the case would continue on Monday because judge Duncan Gaswaga – who is hearing the case – was not available yesterday.

Mr Volcère is accused under section 114 of the Penal Code of attempting to prejudice Court of Appeal judge Matilda Twomey, calculating to lower her authority, showing intentional disrespect to the judicial proceedings in which the Court of Appeal was hearing the Popular Democratic Movement’s petition against a ruling of the Constitutional Court, and contempt of court under common law as contained in the English Law.

Mr Volcère allegedly committed the offence on December 9 when he published an article referring to the judge and other members of the Court of Appeal panel under the heading: Dirty tactics to get David Pierre into the Assembly.
