National Assembly rejects motion to annul Statutory Instrument 103 of 2025 |08 April 2026

The National Assembly has rejected a motion tabled by leader of the opposition, Hon. Bernard Georges, seeking to annul Statutory Instrument 103 of 2025, the Defence (Board of Inquiry on Importation of Firearms) Regulations, 2025.

The statutory instrument, dated December 31, 2025, and laid before the Assembly on February 10, 2026, provides for the establishment of a board of inquiry to investigate matters related to the importation and storage of firearms and ammunition in Seychelles.

Hon. George’ motion, which was seconded by the elected member for Beau Vallon Hon. John Hoareau, did not get the National Assembly’s approval.

In presenting the motion, Hon. Georges explained that, in accordance with Section 64(2) of the Interpretation and General Provisions Act, Cap 103, he was asking the Assembly to annul Statutory Instrument 103 of 2025.

He described the motion as a small motion with significant constitutional consequences, highlighting that the Constitution grants the National Assembly sole legislative power, and only the legislature has the authority to pass laws.

Hon. Georges noted that because the National Assembly cannot pass all laws itself, it delegates authority to various departments and other entities to enact subsidiary legislation or statutory instruments (SIs).
