In passing sentence, Justice Alleear noted that the accused was the cousin of the victim’s step father and very often used to call at their house.

One day after the funeral of the victim’s step father, the accused entered her room while she lay in bed and sexually abused her and took her virginity.

The Chief Justice observed that, that was a monstrous act on the part of a friend of the family.

“The convict took advantage of a young girl in mourning, when he should have been there to console and comfort her,” he said.
